The5ers: rules, terms and fine print

Read this first

Where the money is real, and where it is not

  • The challenge account is simulated. The firm describes the challenge account as simulated, not as trading with the firm's capital.
  • Your fee is real money, and it is spent. The evaluation fee (plus any reset, renewal or activation fee) leaves your bank account. If you fail, it is normally not refunded.
  • A payout is real money, but it is a promise. Profits earned on the simulated account are paid from the firm's own funds, and every firm reserves discretion over payouts and account closure in its terms.
  • Nobody independent verifies payouts. For most firms we found no certified third-party record of what was actually paid. Only the firm's own pages and trackers of unknown method.

Terms: Evaluation trading is 'entirely simulated and is not real'; funds are 'fictitious'. Footer: company 'is not a broker, custodian, exchange, financial institution... and does not hold client deposits'. A successful candidate may be offered Professional User status to 'trade with Our trading capital', where positions are monitored and the Company 'may use our discretion as to whether to execute the suggested trades' (additional terms apply, not read).

Payouts

How rewards are paid

  • First payout: 14 days
  • Minimum: $150 profit (after profit split); High Stakes $50K/$100K FAQ states minimum P&L $300/$500 and payout caps $3,000/$4,000; Summer $100K plans minimum $250, cap $2,000 per cycle
  • Frequency: Bi-weekly: first withdrawal 14 days after the funded account is activated (timer restarts on scaling); subsequent requests every 2 weeks after the last approved withdrawal; all open trades must be closed; review 24-48 business hours; processing up to 3 business days (Withdrawals FAQ, updated 24 Aug 2026).
  • Independent proof: None found: no certified payout aggregator record located. Company figure on about page: '4,376 Monthly zero-fuss payouts' (not independently verified).

Searches on 2026-10-09 for lawsuits, regulator warnings or closures involving The5ers / Five Percent Online Ltd. returned no court case or regulator action. Forum allegations of payout denial after interviews exist (single-source user posts). The site reports company figures (262K traders onboarded, 4,376 monthly payouts) that are not independently verified.

The fine print

Rules and clauses that decide outcomes

  • News trading (High Stakes). 'Performing moves 2 minutes before or after high-impact news events is not allowed.' source
  • News trading (Growth/Bootcamp). News trading allowed except bracket strategies around news or others in the T&C. source
  • Profitable days. High Stakes: 3 minimum profitable days; a profitable day is closed profit of at least 0.5% of initial balance (computed against the lower of midnight balance/equity). Prohibited: strategies that artificially create profitable days by hedging or splitting trades across days. source
  • Inactivity. No activity for over 30 consecutive days: accounts expire (High Stakes/Growth) or are closed (Bootcamp). source
  • Weekend holding. Allowed; indices carry high swap. source
  • Trading Rules in Terms (termination for cause). Listed: arbitrage, HFT with majority of trades lasting seconds or less, bracketing around news, copy trading/trade coordination, one-sided bets, tick scalping, hedge/reverse arbitrage, third-party EAs, EAs without own source code, rollover-scalping EAs, account sharing, circumvention of geo-restrictions incl. VPN, and 'conduct which in the sole discretion of the Company... is not a viable trading strategy'. The Company may suspend or terminate 'immediately for cause'. source
  • Prohibited Trading Practices page (updated 28 Jul 2026). Adds bulk trading (multiple trades open simultaneously), cross-operator coordinated trading, position sizes substantially different from typical activity, and gambling-like or disproportionate speculative positions generating rapid profit even if 'no individual rule threshold was technically breached'. Consequence: 'Any refund or profit will not be processed, and you will be permanently banned.' source
  • Automated trading software. Prior written approval at the Company's sole discretion required for any EA; third-party-owned software prohibited. source
  • Video interview / payout denial. If an interview is requested, scheduling and completing it within five business days is mandatory; failure 'will result in the denial of any pending payouts, immediate cancellation of all associated accounts'. source
  • Forfeiture for statements. Defamatory or disparaging statements about the Company on any public platform, or publishing support correspondence, is a fundamental breach: termination, no refund, accrued profits or Reward Balance 'immediately forfeited'. source
  • Geographic circumvention. Use of VPN to circumvent restrictions is a fundamental breach; on termination fees are not refunded and accrued profits/rewards are forfeited. source
  • Acceptance discretion. Passing Evaluation and verification does not guarantee Professional User status; Company may refuse and reject applications at sole discretion; may unilaterally change fees and parameters (not affecting services already purchased). source
  • Fees and refunds. Evaluation fee non-refundable once Evaluation trading starts; if no trading and no breach: full refund within 5 days of purchase, Hub Credit only after 5 days. No refund after failed evaluation, cancellation or breach; chargebacks can lead to refusal of future service. source
  • Payout instalments. Payouts above a Company-set 'Payout Threshold' may be split into weekly instalments of up to $10,000. source
  • Billing identity. Individuals only (no companies); withdrawals only to an account in the registered user's name; registration details must match payment details. source
  • Drawdown definition (all CFD programs). Equity stop-out is the lowest allowed account value; when equity falls below it 'the fund will close all running trades, and disable trading and access'. Allowance increases with profits kept in the account; payouts reduce the balance and hence the drawdown. source
  • News trading penalty (High Stakes FAQ). Orders executed 2 min before to 2 min after high-impact news (Forex Factory, server time) are prohibited: 'Any profits made at this time will be deducted from the account... Losses will be absorbed by you.' source
  • Inactivity (funded). High Stakes FAQ: evaluation accounts expire after 30 consecutive inactive days (from registration day), funded accounts after 60. source
  • Weekend holding and swaps. Holding overnight and over the weekend allowed on all programs; FAQ warns Crude Oil swap is -$20 and 'x10 on the weekend'; indices carry high weekend swap. source
  • Governing law / jurisdiction (Terms s.19-20). Laws of Israel; exclusive jurisdiction of the courts of Israel / Tel Aviv; no arbitration clause; no EU ADR mechanism mentioned. source
  • Termination for cause (Terms s.10.1). Company may 'terminate the entire relationship' for uncured breaches (10 business days after notice), unjustified chargebacks, breaches of Trading Rules, or failure to attend an interview within five business days; s.14.4 Company may 'close, freeze or suspend Accounts' for regulatory or policy reasons; s.7.5 sanctioned crypto payments frozen, 'No refunds'. source
  • Daily loss on Summer $100K plans. 'When the Daily Loss is reached, the account is permanently terminated' (3% of EOD equity or balance, whichever higher). source
  • Refund policy (FAQ, 6 Oct 2026). Refund available within 5 days of purchase if no transactions; after 5 days only Hub Credits; processed to original payment method in 5-7 business days. source

Legal, regulatory and closure events

  • 2024-02-16. The5ers temporarily suspended onboarding of new US traders: 'Due to recent events, we have made the difficult decision to suspend onboarding new US traders.' Outcome: Suspension until legal implications are clearer; no regulator action named in the article.. source
  • 2026-07-12. User allegation (Forex Peace Army forum, unverified): funded account of nearly two years terminated and a USD 982.47 payout cancelled after a video verification interview. Outcome: Only reply, from an account labelled 'The5ers Representative' on 29 Jul 2026: contact support by email. No resolution shown; identity of the representative not verified.. source
